WHAT IS HAPPENING

The Wisconsin State Assembly Committee on Health will be holding a hearing about Assembly Bill 114, which regulates pharmacy benefit managers and prohibits non-medical switching of medications.

The primary impacts of the bill include:

  • Requires PBMs to register with the Office of the Commissioner of Insurance (OCI)
  • Gives OCI enforcement mechanisms to enforce existing MAC transparency laws and new laws regarding PBMs
  • Bans gag clauses that prohibit pharmacists from informing patients of lower-cost options
  • Prohibits charging patients a copay higher than the prescription’s cash price
  • Bans retroactive claim reductions
  • Reforms audit practices, including the audit’s look-back period cannot be more than two years prior to the date of audit; the auditor cannot be paid based upon recoupment amount, and non-fraudulent clerical errors are exempt from recoupment
  • Prohibits PBMs from using false or deceptive advertising practices
  • Requires PBMs to report the amount of rebates they receive and do not pass along to consumers

WhEN IS THE HEARING?

The Wisconsin State Assembly Committee on Health will be holding a public hearing on legislation that would regulate pharmacy benefit managers in Wisconsin on Wednesday, February 5 at 11 a.m. at the Wisconsin State Capitol.
